Loper Bright Enterprises vs. Gina Raimondo

On July 24, The American Cornerstone Institute filed an amicus brief with the US Supreme Court arguing that it’s time the American people took back our power from unelected Federal bureaucrats and the Courts that enable them. Our brief supports the plaintiffs in the case, Loper Bright Enterprises, who rightly think it’s ridiculous that the Secretary of Commerce, without clear authority from Congress, forces them to not only allow a federal bureaucrat to remain aboard their fishing vessel while at sea, but also force them to pay that bureaucrat’s salary while aboard. In our brief, we argue that the Founders gave the authority to set public policy to Congress, not Executive Branch agencies and the Federal Courts. We’re hopeful that the Court will take our advice and take back the American people’s power from the out of control bureaucracy.
